EXECUTIVE SUMMARY

1. Investigation was initiated after receipt of a report that [REDACTED] provided a USN computer containing child pornography to a computer repair facility under contract with the Military Sealift Command (MSC), San Diego, CA. The San Diego Regional Computer Forensic Laboratory (RCFL) forensically analyzed the computer. The RCFL subsequently notified RA that the hard drive contained approximately 8,400 questionable images and 240 questionable digital video files. On 13Jan05, (1G). xpi was interviewed in a non-custodial setting at MSC, San Diego, CA [REDACTED] }admitted he downloaded child pornography to the laptop computer. A Command Authorized Search AS) was obtained authorizing the search [REDACTED] personal property located at MSC. A USN computer and a second personal computer owned by [REDACTED] were seized and analyzed by the RCFL. The USN computer did not contain any child pornography. [REDACTED] personal computer contained images of child erotica and child pornography. Images of suspected child pornography were provided to the National Center for Missing and Exploited Children (NCMEC) for the purpose of victim identification. NARRATIVE

1. This investigation was conducted under the suspected violations of California Penal Code Section 311.11 (Possession of Child Pornography) .

2. On 28Aug06, in the Superior Court of California, San Diego, CA [REDACTED] plead guilty to California Penal Code Sections 273a(b)-Child Endangerment, 647(a)-Committing a Lewd Act in Public and 313.1-Providing Harmful Matter to a Minor [REDACTED]was sentenced to three months custody, four years probation with a 4th amendment waiver, sex offender counseling for 52 weeks, forfeiture of all seized property, no contact with minors and fined $5,000.00 ($2,500.00 to Camp Hope and $2,500.00 to the National Center for Missing and Exploited Children), Exh (18) refers.
