NARRATIVE

1. STATUTE: This reactive investigation pertains to alleged violations of United States Code (USC) Title 18, Chapter 109 (Sexual Abuse) Section 2241 (Aggravated sexual abuse) aboard Naval Air Station Pensacola, FL (NASP). NCIS retains primary investigative jurisdiction.

2. BACKGROUND: On 15MAR19, at approximately 1515 hours CST, Reporting Agent (RA) was notified by [REDACTED], Civilian Victim Advocate (VA), Sexual Assault Prevention and Response (SAPR) program, NASP of the alleged sexual assault of [REDACTED], CIV, GS07 Supply Technician, Navy Reserve Officer Training Corps (NROTC) Unit, Maine Maritime Academy (MMA), in Castine, Maine. VA [REDACTED] relayed [REDACTED], Executive Officer, NROTC Unit, MMA, Castine, Maine, contacted the NASP SAPR program to report [REDACTED] had complained to command that an unidentified, civilian, conference attendee attempted to engage in non-consensual sexual contact with [REDACTED] on 15FEB19, aboard NASP. According to [REDACTED], an unidentified male invited [REDACTED] to his room located within the Navy Gateway Inn and Suites (NGIS) aboard NASP (NFI) to say goodbye prior to [REDACTED] flying back to Maine following a conference (NFI). [REDACTED] reportedly went to the unidentified male's room where he attempted the non-consensual sexual contact. [REDACTED] reported she was not raped and "got away". [REDACTED] communicated [REDACTED] refused to make a formal statement, was not seeking victim services or a restraining order, and would not participate in an investigation. [REDACTED] stated [REDACTED] filed the report as the unidentified male had attempted to contact [REDACTED] via Facebook and her official email address and wanted command to be aware should the contact escalate. According to [REDACTED], [REDACTED] has since told the unidentified male to stop contacting her and he has complied.

3. DATE OF OFFENSE: The alleged incident occurred on 15FEB19.

4. TIME OF OFFENSE: The time of the alleged offense occurred in the morning hours between 0600 and 0800 hours CST.

5. LOCATION OF OFFENSE: The location of the alleged incident occurred aboard Naval Air Station Pensacola (NASP), FL at NGIS; the specific room is unknown.

10. SEXUAL ASSAULT RESPONSE COORDINATOR: On 15MAR19 [REDACTED], Sexual Assault Response Coordinator (SARC), NASP, was contacted and on 15MAR19, and 17MAR19, VA} [REDACTED], NASP was contacted.

11. TRIAL COUNSEL NOTIFICATION: On 15MAR19, and 17MAR19, RA notified and collaborated with [REDACTED], Officer In Charge (OIC), Regional Legal Service Office (RLSO), Southeast, Detachment Pensacola, FL [REDACTED] concurred that the US Criminal Code (vice state or UCMJ) applies to this case as the alleged assault occurred within exclusive federal jurisdiction and perpetrated by a civilian. The details of the assault, as provided above, do not satisfy the elements of a violation of United States Code (USC) Title 18, Chapter 109 (Sexual Abuse) Section 2241 (Aggravated sexual abuse); or 18 USC 2242 (Sexual abuse); or 18 USC 2244 (Abusive sexual contact).
