NARRATIVE

1. This reactive investigation pertains to possible violations of Article 120 (Abusive Sexual Contact) of the Uniform Code of Military Justice (UCMJ) .

2. On 30Oct17, NCISRA Sasebo was notified by NCISRA Marinas of an allegation of abusive sexual contact pertaining to [REDACTED], Helicopter Sea Combat Squadron 25 (HSC 25), aboard the USNS Charles Drew (T-AKE-10). NCISRA Marinas reported the allegation was a third party complaint made to the HSC 25 command and that [REDACTED] not desire to make a statement or participate in any NCIS investigation. NCISRA Marinas relayed the alleged offender was [REDACTED], HSC 25, and the incident reported to command was inappropriate touching of [REDACTED] thigh and underneath her shirt aboard the USNS Charles Drew after a liberty call. NCISRA Marinas reported the USNS Charles Drew would be arriving to Fleet Activities Sasebo on 30Oct17 for a liberty call and asked NCISRA Sasebo to make contact with [REDACTED] command in an attempt to interview her.

On 30Oct17 [REDACTED] interviewed and stated that she did not desire to provide a statement as she did not want the allegation to be reported to her command and subsequently to NCIS; Exhibit (1) pertains [REDACTED] reported she did not want to wait until 31Oct17 to sign a Victims Preference Statement (VPS) and requested to sign it then. The usage of a VPS was approved by SSA [REDACTED] indicated she had previously spoken with a uniform victim advocate (UVA), identified only as)\6), [REDACTED] was provided a victims witness assistance pamphlet (VWAP) by NCIS [REDACTED] informed by NCIS that she could return at anytime to provide a statement pertaining to the allegation if she desired.

On 31Oct17, [REDACTED], Commander, ESG 7; [REDACTED], Staff Judge Advocate, ESG 7; [REDACTED], Senior Trial Counsel; and [REDACTED], SARC, notification and collaboration was completed within 24 hours of receipt of the allegations to NCISRA On 01Nov17, [REDACTED] were collaborated with again. The UVA who [REDACTED] with was identified only a [REDACTED]collaboration with Sasebo. Command an [REDACTED] did not identify a UVA with that name so no notification or collaboration occurred with the UVA.
