EXECUTIVE SUMMARY

1. This Limited Assist investigation was initiated pursuant to a verbal request for assistance from Detectives of the Saipan Department of Public Safety (SDPS) in interviewing[REDACTED] After providing Reporting Agent the details their investigative efforts, the SDPS explained they initiated their investigation under suspected violations of Article 1301 of Section 1 of Chapter 6 of the Criminal Code of the Commonwealth of the Northern Marianas Islands, Sexual Assault in the First Degree. SDPS will maintain full investigative and prosecutorial primacy. As this alleged assault occurred within the jurisdiction of the aforementioned, the normal protocols for notifying all members of the Special Victim Investigation and Prosecution (SVIP) Capability consisted of notifications to [REDACTED]employer. SDPS Detectives have been in contact with the Commonwealth Prosecutor's Office. As a non-military dependent civilian [REDACTED] does not rate representation from uniformed Victim Legal Counsel. NCISRA New Orleans Special Agents made several attempts to interview [REDACTED] actively avoided contact with the attending Federal Agents. The request for limited assistance by the SDPS has been fulfilled and no further request for assistance is anticipated. This NCIS Limited Assistance investigation is closed.

NARRATIVE

1. This Limited Assist investigation was initiated pursuant to a verbal request for assistance from Detectives of the Saipan Department of Public Safety (SDPS) in interviewing(h[REDACTED] SDPS initiated their investigation under suspected violations of Article 1301 of Section 1 of Chapter 6 of the Criminal Code of the Commonwealth of the Northern Marianas Islands, Sexual Assault in the First Degree. SDPS will maintain full investigative and prosecutorial primacy.

2. On _31May16, Reporting Agent (RA) made telephonic contact with Detective (DET) [REDACTED], SDPS. According to DET [REDACTED] [REDACTED] reported how, during the early morning hours of 28May16, she boarded a civilian owned and operated liberty boat, LEATHERNECK, in Saipan's Charley Dark Harbor, with the intention of returning to the USNS 1ST LT JACK LUMMUS (T-AK-3009), Mobile Sealift Command (MSC). Upon reaching the MSC vessel [REDACTED] denied access due her extreme state of alcohol intoxication and re-boarded the LEATHERNECK. When the LEATHERNECK returned to the harbor [REDACTED] claimed she woke up a short time later to the same man engaging in sexual intercourse with her, and then fell back asleep [REDACTED] celaimed she next recalls being escorted up a flight of stairs on the LEATHERNECK by her assailant, sitting down in a chair at a table in the passenger area of the LEATHERNECK, and falling back to sleep. According to DET [REDACTED] [REDACTED] examined by medical professionals employed by Commonwealth Healthcare Hospital on 28May16, and underwent a Sexual Assault Forensic Examination (SAFE) . DET[REDACTED] explained SDPS Technicians executed a forensic examination/exploitation of the alleged crime scene on 28May16, and physical evidence was collected. DET[REDACTED] unable to articulate how or when the collected evidence, to include the SAFE kit, would be analyzed ina possible subject. Exhibit (1) pertains.

3. On 21Junl6, 27Junlé6é, 28Junl6, 29Junl6é, and 30Jun16, Special Agent (SA) [REDACTED] NCISRA New Orleans, made attempts to interview(t[REDACTED] Icactively avoided SA [REDACTED] attempts of interview.
