EXECUTIVE SUMMARY

1. This investigation was initiated on 20APR11 following notification from NCISRA Dubai, UAE, that [REDACTED], a former USNS RAPPAHANNOCK (T-AO 204) crew member, had reported being sexually assaulted by the vessel's Medical Services Officer (MSO), later identified as [REDACTED], aboard the USNS RAPPAHANNOCK (T-AO 204). [REDACTED] allegations were initially reported to [REDACTED], MSO, USS TIPPECANOE (T-AO 199), during a telephone conversation between [REDACTED] and [REDACTED] on 19APR11 and subsequently reported by [REDACTED] to NCISRA Dubai, UAE. According to [REDACTED], [REDACTED] related something bad had happened and she needed to leave the ship to seek treatment for her alcohol problem. [REDACTED] further related on an unspecified date, she had been drinking with [REDACTED] and subsequently proceeded back to her cabin aboard the USNS RAPPAHANNOCK, where she was raped. [REDACTED] advised [REDACTED] further reported speaking with [REDACTED], Master, USNS RAPPAHANNOCK, about leaving the ship following the incident due to her problems with alcohol and did not report the alleged sexual assault to [REDACTED]. Subsequent interview of [REDACTED] was conducted by NCIS wherein she stated she had no intention of reporting the incident as a crime and opined that after telling [REDACTED] she had "drunk sex" with the MSO, [REDACTED] took her words out of context in reporting the incident as a possible sexual assault to law enforcement authorities.

NARRATIVE

1. This reactive investigation was initiated pursuant to suspected violations of Title 18 United States Code (USC) 2241 (Aggravated Sexual Abuse) and 18 USC 2242 (Sexual Abuse).

2. On 20Apr11, Reporting Agent (RA) contacted [REDACTED], Master, USNS RAPPAHANNOCK, in an effort to locate and interview [REDACTED] regarding her sexual assault allegations. [REDACTED] advised that he was unaware of [REDACTED] allegations against [REDACTED] and advised [REDACTED] approached [REDACTED] during the early morning hours of 17APR11 requesting to be relieved from her watch on the ship. [REDACTED] subsequently reported having sex with [REDACTED] the previous evening, which she now regretted. [REDACTED] further related she may have invited [REDACTED] into her room and due to her level of intoxication was unsure of how events transpired leading up to sexual intercourse with [REDACTED]. [REDACTED] advised she was not raped and did not want to make a complaint against [REDACTED]. [REDACTED] stated following his conversations with both [REDACTED] and [REDACTED], both he and [REDACTED] completed written statements documenting their interactions and conversations with [REDACTED] following her report of sexual contact with [REDACTED]. Further, [REDACTED] advised that [REDACTED] also provided a written statement regarding his sexual contact with [REDACTED], [REDACTED] having sexual intercourse in [REDACTED] quarters, Exhibit (1) pertains and provides amplifying detail.

3. On 10May11, [REDACTED] CIV, was interviewed by Participating Agent (PA) [REDACTED]. [REDACTED] related she had not intended for this incident to be reported as a crime and questioned why she was being interviewed. [REDACTED] stated she had told her friend David [REDACTED] that she had "drunk sex" with [REDACTED] and opined [REDACTED] took her words out of context, subsequently reporting the incident as a possible sexual assault. At the conclusion of her interview [REDACTED] reiterated she was not reporting a crime and signed a Victim Preference Statement, Exhibit (2) pertains.

4. Due to the lack of identifiable violations of either Title 18 United States Code (USC) 2241 (Aggravated Sexual Abuse) and 18 USC 2242 (Sexual Abuse), this investigation is closed.
