Byrd (T-AKE-4). On 01dun21 [REDACTED] ¢)was interviewed and reported [REDACTED] pressed his groin area against her buttocks on three (3) separate occasions while onboard the USNS Richard E. Byrd. According to [REDACTED] first incident took place during Feb21 through Apr21 in the Officer's Wardroom. The second incident also took place in the Wardroom on 14May21 and 20May21. The third incident took place on 20May21 outside the Wardroom in the passageway next to the scullery. On 0OlJun21 multiple witness interviews were conducted. NARRATIVE

1. This reactive investigation pertains to suspected violations of 18 USC 2244 (Abusive Sexual Contact).

2. On 28Feb22 [REDACTED], Southern District of California Assistant United States Attorney declined to prosecute the case. Exhibit (13) pertains.

3. During the captioned investigation [REDACTED] fingerprints, photographs, and DNA were not obtained; therefore, an R-84 will not be submitted to the Federal Bureau of Investigation.

4. During the course of the captioned investigation, SVIP notifications were made to the following individuals [REDACTED], Sexual Assault Response Coordinator (SARC) [REDACTED], Victim Advocate; the Assistant United States Attorney's Office. Notifications were made on the following dates: 21May21, 22May21, 15Jul21, and 28Feb22. 5 [REDACTED] Commanding Officer, MSCPAC, will be updated on this investigation upon receipt of this report.
