On 19Mar19, NCIS Resident Agency (NCISRA) Sasebo, Japan, was notified by [REDACTED], Sexual Assault Prevention and Response (SAPR) Program Manager, Military Sealift Command (MSC), Norfolk, VA, of an unrestricted report of sexual assault. Crime scene documentation of USNS Wally Schirra Navigation Bridge was completed. An attempt to conduct an interview with [REDACTED] made; however, he advised he would not consent to any questioning without a lawyer present. Additional contact with [REDACTED] lawyer determined he would not consent to an interview. On 16Dec19, USFJ Deputy SJA advised that no criminal charges would result from this incident against [REDACTED] USCG would not recall [REDACTED], to active duty. MSC Far East is pursuing potential administrative actions. This investigation is closed.

NARRATIVE

1. This reactive investigation was initiated pursuant to suspected violations of 18 USC 2244 (Abusive Sexual Contact) and/or Article 120 (Abusive Sexual Contact) of the Uniform Code of Military Justice (UCMJ) .

2. On 17Decl19, [REDACTED], Commodore, Military Sealift Command (MSC) Far East, and [REDACTED], Counsel, MSC Far East, were briefed on the status of captioned investigation [REDACTED] Cadvised MSC is conducting an administrative investigation concerning allegations involving [REDACTED], GS-15, previous Ship Master, USNS Wally Schirra (T-AKE-8). On 16Dec19, [REDACTED], GS-15, Deputy Staff Judge Advocate, HQ US Forces, Japan, advised [REDACTED]} would not be recalled to active duty for trial regarding the allegations, which he confirmed through the USCG JAG.
