NARRATIVE

1. This reactive investigation was initiated pursuant to a suspected violation of Article 120 (Sexual Assault) of the Uniform Code of Military Justice.

2. On 06SEP16, [REDACTED], CO, USNS PULLER (ESB-3), Naval Station Norfolk, VA, reported an alleged sexual assault. (by), [REDACTED] reported that SA [REDACTED], USNS PULLER reported to her command that she had been touched on the hip by [REDACTED] USNS PULLER. [REDACTED] reported the USNS PULLER was underway and would not be back in port until the afternoon of 09SEP16. Due to being underway the USNS PULLER would have limited communications and sabe eunicnnahie), tore [REDACTED] would not be available until the ships return.

3. On 09SEP16, at approximately 1700, Reporting Agent (RA) spoke wie [REDACTED] regarding the incident. [REDACTED] indicated SAbj[REDACTED] would be at the NCISRA Norfolk office at 1000 on 12SEP16 for an interview.

4. On 12SEP16, RA and Participating Agent (PA) [REDACTED] ‘interviewed SA (4[REDACTED] Stated at the beginning of the interview that she did not feel she was the victim of sexual assault. SA [REDACTED] stated the reason she reported the incident was she wanted someone from her command to speak with [REDACTED] would stop making sexually explicit comments to her and stop looking at her in a sexually suggestive manner. SA [REDACTED] went on to report that [REDACTED] approached her at the door to female berthing and asked about an incident involving [REDACTED] USNS PULLER. SAbj[REDACTED] Stated that she had been accused of making out wi ttin(é [REDACTED] onboard the USNS PULLER. SA [REDACTED] reported — [REDACTED] hands on her waist and made a sexually explicit comment. SA [REDACTED] i\cstated she rebuffed [REDACTED] told him nothing happened with [REDACTED] y _ and nothing was going to happen with [REDACTED] reported [REDACTED] left female berthing and there was no additional contact between the two. SA [REDACTED] said that after this incident she went to do her laundry. SA [REDACTED] moticed (by), [REDACTED] sitting in a space onboard the ship where [REDACTED] could observe SA [REDACTED] cwalking through the passageway back and forth to the laundry. Sholecpynicreported [REDACTED] would make sexually based comments to her that made her uncomfortable whenever he saw her. Additionally, SA [REDACTED] Cdisclosed that she had spoken to [REDACTED] after she reported the incident. [REDACTED] attempting to convince SA [REDACTED] withdraw her complaint so that he could go on leave. SA [REDACTED] reported during this interaction [REDACTED] touched her on the arm between her shoulder and her elbow. Upon further victim of sexual assault and that [REDACTED] y c) had only touched her on the waist and the arm, Exhibit (1) pertains.

5. It was determined that this incident did not meet the elements of Article 120, but rather Article 128 (Simple Assault) of the UCMJ. This reporting is being forwarded back to command for action deemed appropriate, and this investigation is closed at this time.
