NARRATIVE

1. This incident was reported as a possible violation of Article 120 (Rape, Sexual Assault, Other Sexual Misconduct), Uniform code of Military Justice.

2. On 007Nov12, [REDACTED], CTF-53 Deputy Commodore, contacted NCIS via telephone, while at sea aboard the USNS CATAWBA [REDACTED] reported that he had received a complaint of sexual harassment from [REDACTED] GS-9, CIV, Third Officer, USNS CATAWBA, by another CATAWBA crew member [REDACTED] indicated there was no violent crime, forcible sexual touching, or an incident involving any crime scene of evidentiary value. § [REDACTED] indicated he had instructed the alleged harasser, [REDACTED] EQ3, USN, USNS CATAWBA, to stay away from[REDACTED] the near term, as the USNS CATAWBA would be arriving back in port within with next several days.

On 11Nov12[REDACTED] was interviewed, wherein she divulged a series of consensual sexual encounters with [REDACTED] over the course of several weeks (late October 2012 to early November 2012), many of which were iny)[REDACTED] stateroom aboard the USNS CATAWBA. Upon learning of [REDACTED] desire to have a "relationship" beyond the routine consensual sexual encounters[REDACTED] declined [REDACTED] further requested consensual sexual intercourse as a means of having closure to their "relationship" during the same discussion [REDACTED]additionally declined this request.

4. Subsequent to [REDACTED] request for consensual sexual intercourse irca 07Nov12 [REDACTED] sought an additional encounter in(u[REDACTED]stateroom. After opening the door for [REDACTED] enter her room [REDACTED] Geclined [REDACTED] attempted hug and requested for [REDACTED] leave the stateroom, wherein [REDACTED] complied with [REDACTED] yrequest :

Although[REDACTED] Helt uncomfortable with [REDACTED] visiting her stateroom on 9)[REDACTED] €) 07Nov12 , ( statements indicated that [REDACTED] not commit a crime against her, as described in Article 120, UCMJ. Further[REDACTED] stated that she simply wanted her command to address [REDACTED] actions. Data base inquiries were conducted via MTAC on both individuals involved in this incident. Results were negative.

6. Due to lack of criminal elements in this complaint, this case is closed.
