EXECUTIVE SUMMARY

1. On 18FEB16, [REDACTED] JAGC, USN, Region Legal Service Office Japan Detachment Singapore notified NCISRA Singapore of an alleged abusive sexual assault at Galaxies Night Club & Bar in Sasebo, Japan on 03FEB16. Initial details of the reported incident were gleaned from the Navy Unit SITREP, Military Sealift Command (MSC) email correspondence and statements from crew members of the USNS HENSON (T-AGS 63) and USNS BOWDITCH (T-AGS 62). Between 2000-2200 on the evening of 03FEB16, = [REDACTED] contract mariner serving as the ship's bosun on the USNS HENSON (T-AGS 63), aggressively grabbed the buttocks of a Naval Oceanographic Office government employee [REDACTED] cwho was deployed on the USNS BOWDITCH (T-AGS 62). Later in the evening, [REDACTED] reportedly made a sexual comment to [REDACTED] while in a bar in an area known as "Sailor Town" in Sasebo, Japan. Witnesses observed [REDACTED] grab[REDACTED] jbuttocks and provided statements to such, however; no witnesses reported to have heard [REDACTED] sexual comments to [REDACTED] Sexual Assault Response Coordinator (SARC), Navy Region Center Singapore (NRCS) was notified. When [REDACTED] was contacted, she did not wish to participate in captioned investigation and subsequently signed a Victim Preference Statement (VPS) to document her decision [REDACTED] was provided a Victim Witness Assistance Program (VWAP) pamphlet. [REDACTED] dismissed from the USNS HENSON on 28FEB16 and has subsequently filed a grievance for wrongful termination. Record checks were completed, wherein; no derogatory information surfaced. [REDACTED] subsequently provided a Sworn statement, after waiving his Miranda Rights, attesting that he did grab the buttocks of)[REDACTED] unknown reason and, in turn, immediately apologized to her. A crime scene review was completed. Screening interviews of Galaxies Bar employees were conducted and did not afforded any investigative insight. CCTV coverage was not available for the location of the incident. On 5Mayl16, the U.S. Department of Justice, Human Rights and Special Prosecutions Section declined to prosecute this investigation under the Military Extraterritorial Jurisdiction Act.

NARRATIVE

1. This reactive investigation pertained to an alleged violation of 18 U.S. Code 3261 - Criminal Offenses Committed by Certain Members of the Armed Forces and by Persons Employed By or Accompanying the Armed Forces Outside the United States and its application to 18 U.S. Code 2244 - Abusive Sexual Contact.
