EXECUTIVE SUMMARY

1. The Naval Air Station Whidbey Island (NASWI) Sexual Assault Response Coordinator (SARC) and Naval Ocean Processing Facility (NOPF), Whidbey Island, WA reported, that [REDACTED], reported she was sexually assaulted by [REDACTED], on 04Jun14 in her quarters at White Beach Naval Port Facility, Okinawa, Japan, while her forward deployed assigned vessel, USNS ABLE was in port. [REDACTED] Stated [REDACTED] "pretty drunk," flopped on top of her while she was lying down in a bed in one of the bedrooms, then said, "I want to fuck you." [REDACTED], reportedly told him "no" and he responded, "You know you want to." [REDACTED] Stated [REDACTED] tried to kiss her mouth, but missed and kissed her ear/neck/cheek, and then she pushed him off of her and he got out of the bed(p[REDACTED] room, and laid down in an adjacent bed. [REDACTED]} denied consuming alcohol that evening. [REDACTED] provided with an additional Victim/Witness Assistance Program pamphlet and Victim's Legal Counsel Organization brochure. Interviews of all individuals who were reported to have stayed overnight at the cabin have been conducted. Subsequently [REDACTED] re-interviewed using technical assistance; wherein, no opinion could be rendered by the examiner. [REDACTED] fingerprints have been collected and his DNA has been previously submitted to CODIS. Active investigation is complete. This case is pending judicial and/or administrative action.

NARRATIVE

1. This reactive investigation was initiated to investigate alleged violations of the UCMJ Article 120 (Abusive Sexual Contact), after [REDACTED] Feported she was sexually assaulted by [REDACTED] y c) } All previous investigative actions are captioned under References (A) through (D).

2. On 18Feb15, [REDACTED], Executive Officer NOPF Whidbey Island provided Reporting Agent (RA), the Sexual Assault Disposition Report (SADR) pertaining to the reported sexual assault of [REDACTED] SADR findings show that on 12Feb15, Region Legal Service Office Northwest senior trial counsel recommended not taking action consistent with a court-marital for violation of UCMJ Article 120 (Abusive Sexual Contact), due to lack of probable cause, but did recommend considering administrative action for violations of UCMJ Article 128 (Assault). Based on this recommendation, at Mast [REDACTED] found guilty of violation of UCMJ Article 128 and awarded a written letter of reprimand; Exhibit (16) pertains.
