EXECUTIVE SUMMARY

1. Investigation initiated on 17Jul10 after notification from the Master of the USNS PATUXENT (TAO-201), that a crewmember was claiming to have been sexually violated by a fellow crewmember at a nightclub in Rota, Spain. NARRATIVE

1. On 17Ju110, Reporting Agent (RA) was notified by the Master of the USNS PATUXENT (TAO-201) that a black male crewmember was alleging that he had been "sexually violated" by a white male officer crewmember at a nightclub in Rota, Spain. Upon arrival to the Master's office, Reporting Agent was advised by [REDACTED] Master, USNS PATUXENT, that [REDACTED] insisted on seeing the captain that morning. According (eat ans wwas aggravated and appeared to be quite intoxicated [REDACTED] claimed that Third Engineer [REDACTED] called him a "nigger" and had grabbed him on his buttocks making)[REDACTED] sexually violated. Due _to his state of intoxication j [REDACTED] advised that he would speak)(5 [REDACTED] tater in the day. According to [REDACTED] 0600B [REDACTED] then went the Chief's lounge and proceeded to destroy the lounge and furniture there in [REDACTED] contained and taken to medical. Later in the day, he met with ie tacalegnd provided a written statement where in he states)[REDACTED](G)called him a "nigger" and touched his left butt cheek in a way that made him feel "sexually violated". On 17Jul1e, RA intervicwetib, \Chonboard the USNS PATUXENT in regards to this incident [REDACTED] provided a signed and sworn statement wherein he states that while at the Black Cat nightclub after a night of drinking alcohol he was grabbed on the buttocks. When he turned around [REDACTED] was there. This made [REDACTED] angry and he confronted [REDACTED] about it [REDACTED] admits he said some things to [REDACTED] that he shouldn't have. [REDACTED] repeatedly denied it, but later apologized and according to [REDACTED] that made him even angrier at which time he grabbed and pushed him. [REDACTED] states that as [REDACTED] was getting into a taxi outside the club, [REDACTED] called him a "nigger", exhibit (4) pertains.

On 17Jul10, RA interviewed [REDACTED] onboard the USNS PATUXENT in regards to the incident [REDACTED] advised on the night of 16JUL10, he met with [REDACTED] Pizza Villa restaurant on base at NAVSTA Rota. They then went to the Champions Sports bar on base. From there they went to Chucky's, a bar in Rota, Spain, and from there they went to a nightclub called the Black Cat. They had been drinking alcohol throughout the night and continued to drink when they got to the Black Cat. It was at the Black Cat that they ran into [REDACTED] According to [REDACTED] it wasn't long before he observed [REDACTED] and [REDACTED] arguing [REDACTED] kept asking [REDACTED] if he was a homosexual [REDACTED] denied repeatedly the accusations [REDACTED] Over time, this progressed to calling him a "Fag" and according to [REDACTED] obvious that[REDACTED] getting frustrated. Whilé [REDACTED] sure exactly what time it was, they all ended up outside around 0600 on 17JUL10. [REDACTED] advised that as [REDACTED] was getting in a taxi he heard [REDACTED] say "Nigger". [REDACTED] opined that it was payback for calling [REDACTED] "Fag" all night [REDACTED] stated that he never observed[REDACTED] toucia [REDACTED] anybody else that night in an inappropriate manner. On 17Jul10, aboard the USNS PATUXENT (TAO-201), Sean Anthony [REDACTED] interrogated after proper advisement of legal rights in regards to the allegation that he had indecently assaulted a fellow crewmember [REDACTED] the Black Cat nightclub in Rota, Spain. He did admit the possibility of brushing up against him in a crowded nightclub, but states he never grabbed or intentionally touched [REDACTED] guttocks.
