EXECUTIVE SUMMARY

1. On 15SEP19, the NCIS was notified of an abusive sexual contact involving [REDACTED] complaint was brought forward by [REDACTED], (0\ USN, Command Managed Equal Opportunity Officer MEO) during a sexual harassment complaint initiated by [REDACTED] According to the information provided by [REDACTED] felt he was being sexually harassed by [REDACTED] specifically on one occasiomn#)6 [REDACTED] ¢)placed his chest up against [REDACTED] chest and used words to the effect, "I know what I want, and nothing is going to stop me." Additionally, during that same day [REDACTED] approached [REDACTED] showed him a naked picture of a sailor which was maintained on his cellular telephone (NFTI). Additionally [REDACTED] disclosed that on approximately 08AUG19, while in the head within the Enlisted Berthing area aboard the USNS Comfort [REDACTED] grabbed his buttocks while he was brushing his teeth. According to [REDACTED] these incidents took place while the USNS Comfort was in port in Curacao, circa AUG19. Upon learning of the abusive sexual contact, [REDACTED] terminated the interview with [REDACTED] referred the complaint to his chain of command for appropriate action. According to [REDACTED] reluctant to report the aforementioned allegations to the NCIS. On 16SEP19, the NCIS attempted to interview [REDACTED] reference to the aforementioned allegation; however [REDACTED] elected not to participate/assist in an investigation and provided the NCIS with a signed Victim's Preference Statement. Enough information was gathered from [REDACTED] ascertain where the alleged incident occurred, and the area was ultimately photographically documented. Additionally [REDACTED] stated that an acquaintance of his, [REDACTED], was also being sexually harassed by [REDACTED] however, a Subsequent interview of [REDACTED] revealed [REDACTED] never felt that he had been sexually assaulted/harassed by [REDACTED] 18Sep19, [REDACTED] interrogated and denied ever sexually assaulting or sexually harassing [REDACTED] This investigation was transferred to NFHV due to [REDACTED] being transferred back to his permanent duty station, the naval Medical Center Portsmouth (NMCP). On 18MAR20 [REDACTED] interviewed where he claimed [REDACTED] would lightly touch his arm and grab his hair. He also accused [REDACTED] being mean to him. On 19MAY20 [REDACTED] re-interrogated regarding the allegations where he emphatically denied touching [REDACTED] This investigation was reviewed by the Regional Legal Service Office (RLSO) Mid-Atlantic. The Prosecutorial Merit Review (PMR) recommended against preferring criminal charges due to lack of corroborating evidence. The final disposition by the command was to take no further action. This investigation is closed.

NARRATIVE

1. This reactive investigation was initiated pursuant to a suspected violation of Article 120 (Abusive Sexual Contact) of the Uniform Code of Military Justice (UCMJ). References (A) through (D) indicate previous investigative activity.

2. On 09SEP20, [REDACTED], was contacted regarding the status of this investigation. [REDACTED] jadvised RLSO would recommend no action be taken by command based on lack of corroborating evidence. Additionally, he concurred there was not sufficient probable cause to collect photographs, fingerprints and a deoxyribonucleic acid (DNA) sample from [REDACTED] Exhibit (13) pertains.

3. On 01OCT20, the Sexual Assault Disposition Report (SADR) was obtained from [REDACTED], Sexual Assault Prevention and Response (SAPR) coordinator for NMCP. The SADR indicated the PMR recommended against preferring criminal charges due to lack of corroborating evidence. The final disposition by the command was to take no further action; Exhibit (14) pertains.

4. On 05OCT20, [REDACTED] (bX 7\ USN, CdA)s6 [REDACTED] JAGC, USN, RLSO; [REDACTED], Sexual Assault Response Coordinator (SARC) were apprised on the closure of this investigation.
