EXECUTIVE SUMMARY

1. On 14Aug17, at 0943, NCISRA Singapore was notified by NCISRA Okinawa of a possible sexual assault aboard the USNS SACAGAWEA (T-AKE-2), currently participating in exercise KOA MOANA 17 in waters in the vicinity of Port Vila, Vanuatu. On 15Aug17 [REDACTED] interviewed aboard the USNS SACAGAWEA and stated on 05Jul17, while the ship was at anchor in Noumea, New Caledonia, she was invited into [REDACTED] room with two other Marines to watch movies on his laptop [REDACTED] stated they watched two movies, but everyone started falling asleep at about 0100 and returned to their rooms. Subsequently [REDACTED] returned to [REDACTED] room to continue watching movies, but soon fell asleep on the bed and woke up to [REDACTED], rubbing her "butt" on the outside of her pants [REDACTED] stated she fell back to sleep and woke up later to [REDACTED] rubbing her lower back under her shirt [REDACTED] advised she asked [REDACTED] what he was doing, but she couldn't remember his answer [REDACTED] advised she remembered waking up at about sunrise and was anxious because she had slept in [REDACTED] room and thought she would be in trouble. As [REDACTED] getting off of the bed [REDACTED] grabbed her right breast and said, "You have nice breast [REDACTED] Stated while on liberty in Fiji, [REDACTED] USMC, broke down and cried in front of her and told her [REDACTED] grabbed her buttocks; Reference (A) pertains. On 04Oct17 NCISRA Kaneohe Bay, HI, assumed case control following the receipt of the physical case file for the captioned investigation. On 11Oct17, [REDACTED] invoked his right to counsel. [REDACTED] ficial Military Personnel File (OMPF) were reviewed. On 06Feb18, NCIS Cyber was unsuccessful in an attempt to conduct a forensic extraction of [REDACTED] cellular phone. [REDACTED] received counseling for abusive sexual contact, fraternization and sexual harassment and was processed for administrative separation. This case is closed.

NARRATIVE

1. This reactive investigation pertains to suspected violations of Article 120 (Abusive Sexual Contact) of the Uniform Code of Military Justice (UCMJ) .

2. On 13Sep18, Reporting Agent (RA) received documentation that [REDACTED] received a 6105 counseling for abusive sexual contact, sexual harassment and fraternization. The counseling was signed by [REDACTED]} and his Commanding Officer [REDACTED] USMC, on 25Jun18. On 11Ju118, [REDACTED] notified he would be administratively separated. The counseling pertained to [REDACTED] USMC, who is discussed in Reference (A). Exhibit (14) provides further details. Attempts were made to obtain the Sexual Assault Disposition Report, but the RA was advised by [REDACTED] USMC, 3D Marine Logistics Group Staff Judge Advocate (SADR), that) [REDACTED]was TDY for approximately a month and a half, and would sign the SADR upon her return.

3. On 20Sep18, RA contacted [REDACTED] USMC, [REDACTED] Victim Legal Counsel, to brief him on the status of the investigation.

4. On 15Oct18, RA submitted [REDACTED] R-84 ase disposition report) via email, to the FBI, after confirming his fingerprints had been submitted into NCIC, and he had an FBI number.

5. Additionally, RA received authorization from [REDACTED] return evidence to [REDACTED] Specifically, [REDACTED] requested the return of his cell phone that was seized at the onset of the investigation, and contained no known contraband. All other evidence will be retained for a minimum of (5) years, as is mandated by policy. This investigation is closed.
