On 15Sep16, NCISRA Atsugi, Japan, was notified by [REDACTED], Family Advocacy Program (FAP), Naval Air Facility Atsugi, Japan (NAFA), that on 16Aug16 [REDACTED] Japanese national dependent wife of [REDACTED] made an unrestricted report of sexual assault and domestic assault against [REDACTED] OX71C [REDACTED] provided that [REDACTED] alleged that circa August 2013 [REDACTED] assaulted and threatened to kill [REDACTED] circa summer of 2014 [REDACTED] raped [REDACTED] additional pertinent details were provided at the time by [REDACTED] From 15Sep16-16Sep16, NCISRA Atsugi, Japan, contacted [REDACTED] telephonically in order to arrange an interview [REDACTED] declined to meet with or be interviewed by NCIS and indicated she did not want to be involved with the above-captioned investigation. Records checks of [REDACTED] were conducted which revealed a previous NCIS investigation for sexual assault and a base security investigation in regards to [REDACTED] punching a Japanese national unconscious. On 17Oct16, FAP returned a NCIS reguest for records pertaining to [REDACTED] records detailed Fhe (exe) bi Kc) reported a history of domestic violence between herself and [REDACTED] dating back to 2013 [REDACTED] specifically alleged that circa August 2013 [REDACTED] threatened to kill her and assaulted [REDACTED] during a domestic altercation wherein [REDACTED] restrained her against her will. [REDACTED] also alleged that circa summer 2014 [REDACTED] raped [REDACTED] 19Oct16, historical crime scene documentation was effected. On 19Oct16, local agency checks with Japanese law enforcement was returned and detailed no previous interaction with [REDACTED] was determined that [REDACTED] assigned to the USNS LEWIS B PULLER within the Norfolk, VA, area of operations (AOR). On 29Nov16, NCISRA Norfolk received and reviewed the case file associated with [REDACTED] assumed invoked his right to remain silent and his right to an attorney. On 11Aug17, [REDACTED], JAGC, Region Legal Service Office Mid-Atlantic (RLSO MIDLANT), Naval Station Norfolk (NAVSTA Norfolk), Norfolk, VA, notified NCIS that Command had closed out this investigation with no judicial/administrative action taken against [REDACTED] logical leads have been exhausted and command took no action against [REDACTED] this investigation is hereby closed.

NARRATIVE

1. This investigation was initiated subsequent to a notification of alleged violations of Uniform Code of Military Justice Articles 120 (Rape, Sexual Assault, or Other Sexual Misconduct), 128 (Assault), and 134 ommunicating a Threat).

2. Subsequent to the publishing of Reference (G), on 11Aug17, [REDACTED], JAGC, Region Legal Service Office Mid-Atlantic (RLSO MIDLANT), Naval Station Norfolk (NAVSTA Norfolk), Norfolk, VA, notified NCIS that [REDACTED] CYSN, Officer in Charge, USN, [REDACTED] PULLER BLUEMILCREW (T-ESB 3), Norfolk, VA, had decided to close this case without taking administrative/judicial action against [REDACTED], USN, [REDACTED] PULLER BLUEMILCREW (T-ESB 3), Norfolk, VA, and that no Sexual Assault Disposition Report (SADR) was required for this case.

3. Investigation closed.
