NARRATIVE

1. This Closed Only reactive investigation was initiated in response to a reported violation of the Uniform Code of Military Justice Article 120 (Rape and Sexual Assault).

2. On 13DEC16, [REDACTED], USNS KANAWHA ( T-AO 196) notified Reporting Agent (RA) of an alleged sexual assault that occurred at approximately 2230 on 13DEC16, in the True Bell Seafarer's center in the Port of Fujairah, UAE, involving [REDACTED] UUSN, assigned to the Embarked Security Intelligence Team (ESIT) on the USNS KANAWHA. RA contacted Sexual Assault Response Coordinator, (SARC) , [REDACTED] advised she spoke with [REDACTED] they told SARC they have no interest in accepting the services of SARC or Victim Legal Counsel (VLC).

3. RA met with [REDACTED], RA asked [REDACTED] 1£ she would be willing to communicate with SARC and VLC [REDACTED] y declined [REDACTED] strongly advised she does not wish to participate in any investigation at this time but agreed to explain the incident that occurred at the seafarer's center [REDACTED] advised that Civilian Mariner, IVMAR) [REDACTED] touched [REDACTED] their face, neck, back, side rib cage, thigh and arm in an overly aggressive manner after repeatedly being told to stop by both victims. [REDACTED] Said he was doing this in an attempt to get attention and CIVMAR [REDACTED] highly intoxicated at the time of the incident [REDACTED] denied being a victim of sexual assault. RA provided [REDACTED] with contact information for RA, SARC and VLC. RA and also provided a Victim, Witness Assistance Program (VWAP) pamphlet and concluded the interview.

4. RA met with [REDACTED] declined contact with SARC but accepted the offer to speak with VLC, [REDACTED], telephonically. Subsequent to the conversation with [REDACTED] provided the following verbal statement: "I don't feel I was a victim of sexual assault. I do not feel like a victim of sexual harassment. I do not feel like making a report". RA provided [REDACTED] with contact information for RA, SARC, VLC and a VWAP pamphlet then concluded the meeting.

5. RA met with [REDACTED]said she witnessed the incident at the Seafarer's center between CIVMAR [REDACTED] ated that CIVMAR [REDACTED] appeared to be highly intoxicated and was aggressively touching, rubbing and tickling (b)( ze) ric} and [REDACTED] forceful manner. [REDACTED] advised these [REDACTED] and [REDACTED] told CIVMAR [REDACTED] stop touching them multiple times and slapped his hands away defensively, but CIVMAR [REDACTED] continued to touch them. [REDACTED]Said the touching was clearly unwanted by the [REDACTED] continued until CIVMAR [REDACTED] passed out at the table in the bar. [REDACTED] advised she did not witness CIVMAR , (p\ } attempt to touch [REDACTED] breasts, buttocks or genitalia. [REDACTED]confirmed she reported the incident to her chain of command without consulting [REDACTED]. RA met with CIVMAR [REDACTED] invoked his 5th Amendment rights in written form. CIVMAR [REDACTED] scheduled to depart the ship for a scheduled vacation hours later.

7. The USNS KANAWHA departed for open seas in less than 24 hours after RA made initial contact with [REDACTED] therefore, Victim Preference Statement forms were not processed. CIVMAR [REDACTED] aboard the USNS KANAWHA when it went underway.

8. RA briefed MSC trial counsel) [REDACTED] advised the circumstances involved in this incident do not meet the threshold to conduct a civilian criminal trial, but the matter may be pursued administratively.

9. Based on the aforementioned circumstances pertaining to this incident, a Sexual Assault Forensic Examination (SAFE), a military protective order (MPO) and a crime scene examination was not conducted. 10 [REDACTED], Commanding Officer, USNS KANAHWA, was briefed on this investigation.

11. Queries were conducted for [REDACTED] CIVMAR [REDACTED] utilizing the Joint Personnel Adjudication System (JPAS), Defense Law Enforcement Data Exchange (DDEX), National Crime Information Center (NCIC), the International Justice and Public Safety Network (NLETS), Defense Central Index of Investigations II), ( ), the Knowledge Network (K-NET), and the Department of Defense Person Search databases. The criminal history queries for above listed personnel yielded indications of a [REDACTED] J-PAS query determined that CIVMAR [REDACTED] and [REDACTED] each possess a Secret level security clearance.
