NARRATIVE

1. This investigation was opened to determine possible violations of the Uniform Code of Military Justice (UCMJ) Article 120, Abusive Sexual Contact. After numerous investigative steps conducted by the Security Detachment aboard Naval Support Facility (NSF) Diego Garcia, no allegations of sexual assault have been made.

2. On 15May17, NCIS Resident Agency (NCISRA) Singapore was notified [REDACTED], JAGC, Staff Judge Advocate, NSF Diego Garcia, about a potential sexual assault that occurred aboard one of the boat launches at NSF Diego Garcia. At the time of notification, all flights to Diego Garcia from Singapore had been cancelled for the week. Due to the inability of NCIS agents to fly to Diego Garcia, NCIS requested that the Security Detachment at NSF Diego Garcia conduct the initial response. The flights from Singapore to Diego Garcia continued to be cancelled throughout May17 and into Junl7 as the NSF Diego Garcia Security Detachment conducted investigative steps relating to the allegation. See Reference (A). The allegations made were that on 14Mayl17, at approximately 2130, a group of individuals got on the launch boat from the island of Diego Garcia that transports individuals over to the prepositioned vessels that are in the lagoon [REDACTED], got onto the launch boat accompanied by three other males; all four are assigned to the USNS LEWIS AND CLARK (T-AKE-1 [REDACTED] (o\ was not wearing a shirt at the time, only a bikini top. As [REDACTED] opened the hatch for the launch boat, her breast allegedly fell out of her bikini top. [REDACTED], USNS LEWIS AND CLARK, upon seeing [REDACTED] naked breast, approached [REDACTED] told her to cover herself up as her breast was exposed [REDACTED] alleged that when [REDACTED] came up to her to tell her to cover herself [REDACTED] touched her breast. 3 [REDACTED] interviewed and said that while she believes [REDACTED] touched her breast, she did not do it with any intent for sexual desire or to harass, humiliate, or degrade her [REDACTED] paid she was not sexually assaulted or harmed_in any way [REDACTED] Cpelieved that [REDACTED] trying to protect her. [REDACTED] denied touching [REDACTED] breast and stated she only touched [REDACTED] Shoulders as she was trying to shield [REDACTED] cfrom the eyes of all the men on board the vessel. 4. As a result of the interview of(H[REDACTED]Lt was determined that no complaint of sexual assault has been made. [REDACTED], xndusn, JAGC, RLSO Japan, concurred. This investigation is closed. Delay in transmitting this report is due to a delay in obtaining concurrence from RLSO Japan. RLSO Japan would not provide concurrence until the Security Detachment report was complete.
