(4[REDACTED] ¢) reported the incident to VBPD and submitted to a Physical Evidence Recovery Kit (PERK) exam [REDACTED]was placed under arrest and was transported to VBPD Headquarters and was served a Temporary Protective Order. On 19SEP11, (i1[REDACTED]was interviewed by NCIS and advised she had sexual intercourse begrudgingly with [REDACTED] the morning of 12SEP11, but she was not raped. This case has been screened with the Virginia Beach Commonwealth's Attorney Office and was found to lack needed evidence for prosecution. Charges for misdemeanor domestic assault were secured by VBPD on 12SEP11 and were subsequently deferred on 14NOV11. No further assistance is requested from NCIS. This case is closed.

NARRATIVE

1. This reactive investigation pertains to the suspected violations of Virginia State Code 18.2-57.2 (Assault and Battery-Family Member) and Article 120 (Rape, Sexual Assault) of the Uniform Code of Military Justice (UCMJ). This case was handled by Virginia Beach Police Department (VBPD).

2. Circa 19DEC11, Participating Agent (PA) [REDACTED] received a report from Detective [REDACTED] VBPD, in reference to the final disposition of the alleged rape case of [REDACTED] report details Detective)[REDACTED] lead investigator in the case. During the course of Detect ive[REDACTED] investigation, he consulted the Virginia Beach Commonwealth's Attorney Office, who declined to prosecute [REDACTED] the charge of rape due to insufficient evidence and inconsistent statements. Virginia Beach Commonwealth Attorney's Office recommended VBPD pursue misdemeanor domestic assault charges. Charges for misdemeanor domestic assault were secured by VBPD on 12SEP11 and were subsequently deferred on 14NOV11, Exhibit (2) pertains.
