EXECUTIVE SUMMARY

1. This joint investigation was initiated with the Saint Louis Metropolitan Police Department (STLMPD) after NCISRU Saint Louis, MO, received information from Detective [REDACTED] Crimes Section, STLMPD, regarding an alleged sexual assault that occurred in the St Louis Metro area involving [REDACTED] According to Detective! [REDACTED] reported on 05Sep12, she was invited to [REDACTED] apartment for dinner and while she was in the living room of his residence, (i[REDACTED] ¢)forced his penis in her mouth for approximately 5 seconds and attempted to remove her pants; however, she demanded that he stop and he complied. On 11Sep12 [REDACTED] again went to [REDACTED] apartment for dinner and while sitting in the living roomy)[REDACTED] again forced his penis in [REDACTED] mouth for a short period of time. On 13Sep12 [REDACTED] went to [REDACTED] apartment and after dinner, he forced her to the floor and engaged in vaginal sexual intercourse against her wil [REDACTED] reported she screamed for him to stop; however, he refused and ejaculated on her stomach. On 07Oct12h)[REDACTED] eeported she traveled to Orlando, FL, with [REDACTED] interviewed(h[REDACTED]. STLMPD regarding the alleged sexual assault allegations in captioned investigation. [REDACTED] claimed the sexual encounters with [REDACTED] were consensual .[REDACTED] reported he dat ed [REDACTED] couple months and after he ended his relationship with her she began to stalk and harass him. Other witnesses developed from the interview [REDACTED] were unable to corroborate [REDACTED] allegations of sexual assault. A sexual assault exam was not completed by [REDACTED] after the incidents. On 16May13, Reporting Agent (RA) attempted to re-interview[REDACTED] to gather amplifying details; however , [REDACTED] declined further interview. On 21May13, Detective [REDACTED] presented captioned investigation to Assistant Circuit Attorney (ACA [REDACTED] City of Saint Louis, MO. After review of the case, ACA [REDACTED] declined prosecution due to lack of evidence. On 06Jun13, Command declined preferring charges against[REDACTED] lack of evidence. NARRATIVE

1. This joint NCIS investigation is being conducted with the Saint Louis Metropolitan Police Department (STLMPD) and pertains to a suspected violation of the State of Missouri Statute, Title 38, Chapter 566, Section 566.030 - Forcible Rape and Section 566.070 - Deviant Sexual Assault. The Uniform Code of Military Justice (UCMJ) Article 120 - Rape also applies.

2. Subsequent to the submission of Reference (B), on 17May13, Reporting Agent (RA) captured photographs of a vacant furnished apartment at Gentry's landing, 400 N 4th St, St Louis, MO. The apartment was similar to the location of the alleged sexual assaults in captioned investigation, which is currently being leased by another tenant. Exhibit (11) pertains.

3. On 20Mayl13, [REDACTED], was interviewed regarding her knowledge of captioned investigation [REDACTED] (o\ reported she had little interaction with [REDACTED] however, she recalled during a brief conversations with [REDACTED] she was informed that [REDACTED] hit her nose causing it to bleed, however, claimed it was an accident.
