On 11Jul12, Reporting Agent (RA) met with [REDACTED] obtained a 17 page sworn written statement detailing [REDACTED] allegations of sexual assault perpetrated by [REDACTED] reported during a temporary additional duty (TAD) assignment in Hawaii in Junll she went to several bars with members of her command. On 18Sep12, photographic scene documentation was conducted on [REDACTED] hotel room. Multiple command members have been interviewed pertaining to their knowledge of above captioned allegations. Multiple interviews have been conducted of civilian members of USNS Safeguard (T-ARS 50) deployed with [REDACTED] company during their latest deployment. Command has been briefed regarding the status of this investigation. A review of the digital media seized from USNS Safeguard revealed nothing pertaining to the above captioned investigation, References (A) - (E) pertain. On 06-07May13, an Article 32 hearing was held in reference to the above captioned investigation. The Investigating Officer found that there are not reasonable grounds to pursue a Court Martial and recommended withdrawing and dismissing the specifications. Command concurred and on 21May13, Command provided the Sexual Assault Disposition Report indicating no action will be taken due to insufficient evidence of any offense and the allegations being unfounded. This case is closed.

NARRATIVE

1. This reactive investigation pertains to suspected violations of Article 120 (Sexual Assault) of the Uniform Code of Military Justice.

2. On 06-07May13, an Article 32 hearing was held in reference to the above captioned investigation. The Investigating Officer found that there are not reasonable grounds to pursue charges against [REDACTED] recommended withdrawing and dismissing the specifications. On 21May13, Command provided the Sexual Assault Disposition Report indicating no action will be taken due to insufficient evidence of any offense and the allegations being unfounded. Exhibit (40) pertains.
