EXECUTIVE SUMMARY

1. On 7AUG20, NCIS Resident Agency (NCISRA) Dubai, UAE was notified by [REDACTED], Counsel, Military Sealift Command/Combined Task Force -53 (MSC/CTF53), via email of an alleged sexual assault of Able Seaman (AB [REDACTED], USNS WALLY SCHIRRA (T-AKE-8). Initial reporting revealed [REDACTED] allegedly been sexually assaulted numerous times by a male crew member starting MAR20 until JUL20 while aboard T-AKE-8. Reporting Agent (RA) interviewed [REDACTED] Fujairah, UAE while T-AKE-8 was in port [REDACTED] stated she was sexually assaulted by [REDACTED], T-AKE-8, on at least five (5) different occasions while in her work)[REDACTED] located in the sail locker on the 3rd deck aboard T-AKE-8. According to [REDACTED] vividly recalled seeing spots on the head of [REDACTED] penis and could visually identify his penis [REDACTED] stated she reported the aforementioned allegations to the Medical Supply Officer (MSO) while in the mess hall onboard T-AKE-8 on 5AUG20 [REDACTED] stated she has personal. [REDACTED] advised he received notification from [REDACTED] the alleged assault in early August 2020. Of the eight (8) crew members interviewed[REDACTED] observed of having inappropriate contact regarding the reported sexual assault of [REDACTED] [REDACTED] described his past relationship with [REDACTED] good and indicated they were romantically involved on at least two (2) occasions in 2016. On one of the occasions [REDACTED] relayed that he and [REDACTED] were both semi-nude and [REDACTED] more than likely visually saw his penis because she looked down at his penis when [REDACTED] stated the last time he was romantic with [REDACTED] four years ago [REDACTED] stated he was aware 21a had a "reputation" for having conflicts with other coworkers [REDACTED] adamantly denied sexually assaulting [REDACTED] Multiple interviews of [REDACTED] coworkers revealed [REDACTED] a history of conflict with previous crew members to include current members and was described as a "troublemaker" and "causing conflict." It was relayed [REDACTED] filed multiple Equal Employment Opportunity (EEO) claims and has been observed being flirtatious with other male crew members, to include 3-85-3) was conducted of the reported abusive sexual contact. On 24AUG20, [REDACTED], Special Assistant U.S. Attorney, was apprised of this investigation and advised no further judicial action would be taken due to insufficient evidence. All logical investigative actions have been completed. All judicial action concluded. To date, no command administrative action has been taken againsth)[REDACTED] This investigation is closed.

NARRATIVE

1. This reactive investigation pertains to the suspected violation of U.S. Code Title 18 Chapter 2244 (Abusive Sexual Contact).

2. On 7AUG20, Reporting Agent (RA) interviewed [REDACTED], USNS Wally SCHIRRA (T-AKE-8) regarding allegations of sexual assault she reported against [REDACTED], T-AKE-8 (subsequently identified as) © [REDACTED] stated she was sexually assaulted [REDACTED] on at least five (5) different occasions, from MAR-JUN20, while in her work [REDACTED] located in the sail locker on the 3rd deck aboard T-AKE-8 [REDACTED] stated the first alleged sexual attempt made was in MAR20 (NFI) wherein [REDACTED] touched and groped her covered breasts and attempted to put his hand up her shirt. In APR20 (NFI), forcefully placed his penis on her cheek and lip. According to [REDACTED], [REDACTED] told three other coworkers to include [REDACTED], [REDACTED]. 8. On 5AUG20 [REDACTED] reported the alleged sexual assault allegations to the Medical Supply Officer (MSO) while in the mess hall onboard T-AKE-8. personal email nor text, Exhibit (1) pertains.

3. On 16AUG20, Participating Agent (PA) [REDACTED] interviewed MSO [REDACTED], T-AKE 8, and advised he(b [REDACTED] meceived notification £rom [REDACTED] the alleged assault in early August 202 Q [REDACTED] bold [REDACTED] anything she told him would be considered an official unrestricted report and he would have to report it to the ship captain and Military Sealift Command (MSC [REDACTED] took an official statement from [REDACTED] notified the MSC HQ Sexual Assault Response Coordinator (SARC), Exhibit (2) pertains.

4. On 16AUG20, RA interviewed [REDACTED], T-AKE-8, regarding the reported sexual assault of [REDACTED] According to [REDACTED] notified of the alleged sexual assault on 6AUG20 and was not privy to any prior Equal Employment Opportunity (EEO) complaints she filed. [REDACTED] relayed he never stated he did not like [REDACTED] but did tell other CIVMARs who report to him to "be careful" of her because she was quite knowledgeable of the EEO process. [REDACTED] stated he was aware that [REDACTED] allegedly was telling other CIVMARs that she could identify the penis of [REDACTED]. [REDACTED] indicated [REDACTED] could not provide any details. According to [REDACTED], [REDACTED] was overdue for her relief off T-AKE-8 and allegedly had stated she was going to do anything to get off the ship. [REDACTED] also advised there were no security surveillance cameras located in either the sail locker or on board T-AKE-8. As a result, no video footage was available, Exhibits (3-4) pertain.

5. On 16AUG20, PA [REDACTED] interviewed [REDACTED], T-AKE 8, who stated she was not friends with [REDACTED] [REDACTED] Gescribed [REDACTED] oe me a troublemaker and person who enjoys drama. [REDACTED] also described [REDACTED] as lazy and someone who takes shortcuts and wants easy money. [REDACTED] said it was well known [REDACTED] filed fake EEO claims on other ships against married male sailors. [REDACTED] recalled a conversation in June 2020 when [REDACTED] told her she had seen [REDACTED] penis and it was pierced. [REDACTED] said she had never heard [REDACTED] tell sexually suggestive jokes or say anything inappropriate with other coworkers. She had never seen [REDACTED] touch anyone nor was he known as someone who rubbed shoulders. [REDACTED] confirmed in mid-June 2020 [REDACTED] told her and [REDACTED], T-AKE-8, that [REDACTED] touched her butt. [REDACTED] said she did not think anything of this comment as [REDACTED] was a known troublemaker and made up things, Exhibit (5) pertains.

6. On 16AUG20, PA [REDACTED] interviewed [REDACTED], T-AKE 8, in reference to this investigation.[REDACTED] ¢)said he was friends with [REDACTED] an [REDACTED] and had never suspected them of having a romantic relationship. In March of 2020, [REDACTED] yheard scuttlebutt she had filed a lot of EEO complaints on previous ships. According to [REDACTED] [REDACTED] a physical person and he had never seen him rub anyone's shoulders or touch them, Exhibit pertains.

7. On 16AUG20, PA [REDACTED] interviewed [REDACTED], T-AKE 8, in reference to this investigation(p [REDACTED] said he was not friends with [REDACTED] described her as overly friendly to him)), [REDACTED] said he felt [REDACTED] trouble and he did not want anything to do with her [REDACTED] stated when [REDACTED] first boarded the ship, she started offering massages to him and asking for massages in return [REDACTED] welayed he never gave nor received a massage from [REDACTED] avoided her because he had heard scuttlebutt about the multiple EEO complaints she had filed on previous ships [REDACTED] said he did not trust [REDACTED] that she was up to no good, Exhibit pertains.

8. On 16AUG20, PA [REDACTED] interviewed [REDACTED], T-AKE 8, regarding the captioned investigation. [REDACTED] jnoted she respected [REDACTED] who was also her supervisor, but included she has an noted [REDACTED] accused her of [REDACTED] having an inappropriate relationship in order to get additional overtime assignments. [REDACTED] related she heard there were several similar pending cases against [REDACTED] but did not know any of the details. [REDACTED] related she never witnessed any inappropriate behavior from [REDACTED] and asserted he never flirted with either (4[REDACTED] KH) Sea she occasionally witnessed [REDACTED] attempting to flirt with [REDACTED] and even offered to give him a massage on occasion, Exhibit (8) pertains.

9. On 16AUG20, PA[REDACTED] interviewed [REDACTED], T-AKE 8, who is a friend of [REDACTED] Roted [REDACTED] known for causing "drama," and "conflict" wherever she went [REDACTED] celaborated saying [REDACTED] a history of conflict with numerous crew members among various USNS vessels (NFI [REDACTED] related he also know )[REDACTED] Quite well and holds him in high regard. According to [REDACTED], the relationship between [REDACTED] and [REDACTED] had been strained and [REDACTED] was caught in the middle of a disagreement [REDACTED] had with [REDACTED]. [REDACTED] explained he heard the rumor of [REDACTED] accusing [REDACTED] of sexual assault, but [REDACTED] stated he thought the notion of [REDACTED] sexually assaulting [REDACTED] was outlandish and extremely unlikely. [REDACTED] was generating conflict to expedite her transfer off the ship so she could return home for] [REDACTED]birthday, Exhibit (9) pertains.

10. On 16AUG20, PA [REDACTED] interviewed [REDACTED], CIV, T-AKE 8, regarding the abusive sexual contact of [REDACTED]. [REDACTED] relayed he verbally counseled [REDACTED] regarding unwanted verbal interactions towards [REDACTED] on 1AUG20, in his office with [REDACTED] present. [REDACTED] said after he was done verbally counseling [REDACTED] "very casually" pointed to [REDACTED] and said he "sexually harassed me." [REDACTED] said he was startled and surprised by [REDACTED] allegation against [REDACTED]. After the meeting [REDACTED] calledé), (b irty (30) minutes later and said she did not [REDACTED](G) $04[REDACTED] want to make a reporth)(é said he has never had any problems or issues with [REDACTED] and has always observed[REDACTED] tnteract professionally with [REDACTED] (o\ \ Exhibit (10) pertains.

11. On 16AUG20, RA and PA [REDACTED] re-interviewed [REDACTED] regarding the alleged abusive sexual contact of [REDACTED] by [REDACTED]. [REDACTED] reported that nothing new transpired since her last interview by NCISRA Dubai on 07AUG20. [REDACTED] conveyed she has not had any interaction with [REDACTED] since her interview and no threats have been made to her. [REDACTED] stated she does not want to change any details during the first interview. [REDACTED] was asked to reconfirm and describe [REDACTED] penis again regarding the description she gave in her first interview. [REDACTED] described [REDACTED] penis as having no piercings on it but had "spots" on the head of his penis that she would be able to identify. [REDACTED] denied telling anyone thap)6 [REDACTED] piercing on his penis [REDACTED] reiterated that no sexual contact betweem)[REDACTED] and herself was consensual, Exhibit (11) pertains.

12. On 16AUG20, PA\[REDACTED] conduced a crime scene examination of the sail locker aboard T-AKE 8 (frame 3-85-3) and was provided a walk through of where the reported abusive sexual contact took place. RA photographed the scene and a sketch was produced, Exhibit (12) pertains.

13. On 16AUG20, RA and PA [REDACTED] interviewed [REDACTED] regarding the reported sexual assault of [REDACTED]. According to [REDACTED], he first met [REDACTED] while working aboard the USNS JOSHUA HUMPHREYS (T-AO-186) in 2016, where he was [REDACTED] for four months. [REDACTED] described their past relationship was good and indicated they were romantically involved on at least two (2) occasions. On one of the occasions [REDACTED] indicated he and [REDACTED] were intimate while aboard the T-AO-186 in his stateroom wherein [REDACTED] was touching his erect penis and both were "heavy petting" each other [REDACTED] relayed that he and [REDACTED] were both semi-nude and [REDACTED] more than likely visually saw his penis because she looked down at his penis when touching it. According to [REDACTED] both incidents were consensual. [REDACTED] stated he was aware [REDACTED] had conflicts with other coworkers aboard both the T-AKE-8 and T-AO-186 and she had a "reputation." He described the conflicts as "having issues with other coworkers" (NFI). According to [REDACTED], he was never romantically involved with [REDACTED] while aboard T-AKE-8 and reiterated the last time he was romantic with her was four years ago. [REDACTED] stated he was not surprised [REDACTED] is making an accusation against him because it is not uncharacteristic of her but was shocked she was alleging a sexual assault occurred. [REDACTED] adamantly denied sexually assaulting [REDACTED]. [REDACTED] also voluntarily offered to have his penis forensically examined after [REDACTED] described his penis as having spots on it. [REDACTED] stated his penis did not have spots and he did not have a piercing. [REDACTED] again suggested [REDACTED] was likely to know what his penis looked like from a previous sexual encounter, Exhibit (13) pertains.

14. On 17AUG20 [REDACTED], Commodore, CTF-53 [REDACTED], T-AKE-8 and [REDACTED], Counsel, Military Sealift Command/Combined Task Force - 53 (MSC/CTF53) were apprised of this investigation.

15. On 19AUG20, RA interviewed [REDACTED] USNS YUKON (T-AO-202) regarding the reported sexual assault of [REDACTED] advised he was aware of an incident involving [REDACTED] a Boatswain Mate (BM) but had no knowledge of who the BM was [REDACTED] stated [REDACTED] made him aware of the incident because she wanted advice on how to file a complaint and [REDACTED] knowledgeable of the process. According to [REDACTED] uncomfortable around the BM due to him making inappropriate comments [REDACTED] stated [REDACTED] provide any further details, Exhibit (14) pertains.

16. On 19AUG20, RA interviewed [REDACTED], regarding the reported sexual assault of [REDACTED] advised [REDACTED] was aware of an incident involving [REDACTED] Gand a male (NFI). According to [REDACTED] provide any details and only relayed that an individual was making advances to persuade her to come to visit their stateroom (NFI), Exhibit (15) pertains.

17. On 19AUG20, RA conducted social media checks on [REDACTED] utilizing Facebook, Instagram Google and Bing. The search revealed no internet profiles for [REDACTED] Exhibit (16) pertains.

18. Between 24-30AUG20, RA made multiple attempts to obtain personnel files for [REDACTED] repeatedly made attempts to contact the Marine Sealift Command (MSC) Human Resources Department with negative results. As such, no FOR , OF FICIAL USE ONLY review was conducted of [REDACTED] personnel file, Exhibit (17) pertains.

19. On 24AUG20, [REDACTED], Special Assistant U.S. Attorney, was apprised of this investigation and advised no further judicial action would be taken due to insufficient evidence. [REDACTED] CIV, SARC, Naval Base Point Loma, and [REDACTED] were also apprised of this investigation.

20. On 20SEP20, RA contacteid(é [REDACTED] eegarding the sail locker door lock located on the 3rd deck aboard T-AKE-8. According to [REDACTED] sail locker door is affixed with a key lockp)(é), [REDACTED] éurther stated that many personnel aboard T-AKE-8 have access to the sail locker via a deck master key. Among those personnel with access included the Captain, Fire Marshall, Command Duty Officer, Chief Mate, and [REDACTED] cExhibit (18) pertains. negative results. Joint Personnel Adjudicated System (JPAS) indicate [REDACTED] holds a secret level security clearance, Exhibit (19) pertains.

23. On 20SEP20, [REDACTED] were apprised of this investigation and advised this investigation is now closed.

24. All logical investigative actions have been completed. All judicial action concluded. To date, no command administrative action has been taken
