NARRATIVE

1. This limited assistance investigation pertains to a suspected violation of 18 USC 2244, Abusive Sexual Contact, and applicable statutes of Sri Lanka's penal code. This alleged crime occurred in Trincomalee, Sri Lanka, and was investigated by the Trincomalee Police Department (TPD). NCIS had no jurisdiction as the subject was a foreign national, and the incident occurred in Sri Lanka.

2. SUMMARY OF INCIDENT: On 08May18, NCIS was notified by [REDACTED], Security Officer (SECO), Pacific Partnership 2018, USNS MERCY (T-AH 19), that} [REDACTED] sexually assaulted by a Sri Lankan National while at a massage parlor close to the Trinco Blu by Cinnamon Hotel, Trincomalee, Sri Lanka.

3. On 08May18 [REDACTED] interviewed by NCIS and reported that she was sexually assaulted by an unknown male, later identified as [REDACTED] while receiving a massage at a Spa, name unknown, in close proximity the Trinco Blu_by Cinnamon Hotel, Trincomalee, Sri Lanka. [REDACTED] liberty partner, [REDACTED], MTF, USNS MERCY, was also present for the interview.) [REDACTED] stated [REDACTED] started with a regular massage, only massaging her legs, arms, shoulders, and back, while she was laying down on her stomach [REDACTED] stated [REDACTED] finished with her back side and told her to turn over onto her back so he could finish the massage [REDACTED] stated [REDACTED] started massaging her legs and moved his hands up to her vagina [REDACTED] stated [REDACTED] began to rub her vagina, he never penetrated her vagina, and she told him to stop, while pushing his hand away [REDACTED] indicated [REDACTED] then grabbed her face and pushed her back down onto the massage table. [REDACTED] related [REDACTED] then tried to move her towel off of her breasts while at the same time trying to put his mouth on her breasts. stated she then yelled at [REDACTED] told him to stop. On 08May18 [REDACTED] were taken to the Trincomalee Police Department (TPD), Trincomalee, Sri Lanka, SO [REDACTED] could file an official police report against [REDACTED] Inspector of Police, Officer in Charge of Child and Women Division, TPD, took an official statement from [REDACTED] informed her of the process for the TPD investigation. Following the aforementioned interview, NCIS took [REDACTED] back to the spa, which was identified as Kandy Spa, at the request of Inspectom)[REDACTED] nspectan (4 [REDACTED] spoke with [REDACTED], Sri Lankan National, Kandy Spa, who confirmed with Inspectom [REDACTED] that an alleged incident of sexual assault occurred between [REDACTED] Inspectan(é), [REDACTED] then asked for [REDACTED] come outside the Spa; wherein, he was then placed under arrest by TPD. On 13May18, the Sexual Assault Disposition Report (SADR) regarding the captioned investigation was obtained from [REDACTED], Staff Judge Advocate (SJA), Pacific Partnership 2018, USNS MERCY (T-AH 19), which indicated command action was not taken against [REDACTED] to offender being outside of the Department of Defense's (DOD's) legal authority. 10. An R-84 form was not submitted due to fingerprints and DNA not being collected because this case was adjudicated by TPD.
