NARRATIVE

1. This limited assistance investigation pertains to a suspected violation of 18 USC 2244, Abusive Sexual Contact, and applicable statutes of Sri Lanka's penal code. This alleged crime occurred in Trincomalee, Sri Lanka, and was investigated by the Trincomalee Police Department (TPD). NCIS has no jurisdiction as the subject is a foreign national, and the incident occurred in Sri Lanka.

2. SUMMARY OF INCIDENT: On 006May18, at approximately 2238, NCIS was notified by [REDACTED], Executive Officer (XO), Medical Treatment Facility (MTF), USNS MERCY (T-AH 19), that at approximately 1622, on 06Mar18, (H[REDACTED] sexually assaulted by a Sri Lankan National working at the Trinco Blu by Cinnamon Hotel, Trincomalee, Sri Lanka.

On 07May18 , [REDACTED] interviewed by NCIS and indicated at approximately 1622 on 06May18, she was at the Trinco Blu by Cinnamon Hotel with her liberty partner [REDACTED] hotel room, and they were both sexually assaulted by a waiter they knew €S)(5 [REDACTED] Gyho was later identified as [REDACTED] Also present for the interview was [REDACTED], Uniformed Victim Advocate (UVA), MTF, USNS MERCY .[REDACTED] related she had ordered a Sprite, and after § [REDACTED] delivered her the drink, he sat down on her hotel bed next to her. After [REDACTED] came into the room, he asked [REDACTED] down next to him [REDACTED] y jadded at this point [REDACTED] sitting between her and [REDACTED] (h[REDACTED] ystated [REDACTED] then leaned back a little and put his right hand around thigh. (h[REDACTED] stated [REDACTED] then stood up, and while he was removing from him, he could leave, and she gave him her credit card to pay for the drink . On 07May18, (H[REDACTED] were taken to the Trincomalee Police Department (TPD), Trincomalee, Sri Lanka, to file an official police report against [REDACTED] Inspector of Police, Officer in Charge of Child and Women Division, TPD, took official statements £ rom[REDACTED] informed them of the process of their investigation. Following the aforementioned interview, NCIS took[REDACTED] back to the Trinco Blu hotel at the request of Inspecto5)6 [REDACTED] Gnspect m6 [REDACTED] spoke with the manager of the hotel and arranged for [REDACTED] meet her outside of the hotel. Once outside and a short distance away from[REDACTED] jand [REDACTED] Inspect qa , (by(q)werified with [REDACTED] that [REDACTED] waiter who sexually assaulted them. Inspect om [REDACTED] placed [REDACTED] under arrest. On 08May18, Inspectomxé [REDACTED] explained that [REDACTED] went before a Trincomalee Judge and received two weeks in jail. On 13May18, the Sexual Assault Disposition Report (SADR) regarding the FOR OFFI L USE ONLY captioned investigation was obtained from [REDACTED], Staff Judge Advocate (SJA), Pacific Partnership 2018, USNS MERCY (T-AH 19), which indicated command action was not taken against [REDACTED] to offender being outside of the Department of Defense's (DOD's) legal authority. 10. An R-84 form was not submitted due to fingerprints and DNA not being collected because case was adjudicated by TPD.
