EXECUTIVE SUMMARY

1. NCIS initiated this reactive investigation in response to the 06JUN19 notification by Naval Medical Center Portsmouth (NMCP) Victim Legal Counsel (VLC) [REDACTED] lregarding an alleged sexual assault reported by HA [REDACTED], USNS COMFORT (T-AH 20) .(t[REDACTED] reported to NCIS that on 16MAR19, while traveling to visit her family near Pittsburgh, PA, [REDACTED], NMCP sexually assaulted her in a room at the Crowne Plaza Suites. On 15MAR19 , (4[REDACTED] traveled together from Portsmouth, VA to Pittsburgh, PA arriving to the hotel at approximately 0400 hours on 16MAR19. At the time [REDACTED] were engaged in a romantic relationship; however [REDACTED] informed [REDACTED] prior to departing Portsmouth, VA that she did not want to engage in sexual intercourse during the trip to Pittsburgh, PA and [REDACTED] verbally agreed. Upon entering their hotel room, (4[REDACTED] Showered together, and then laid down in the hotel bed [REDACTED] complained to [REDACTED] ywhile crying, explaining he wanted to have sex. (4[REDACTED] Cyreiterated her lack of interest in sexual intercourse, and kissed [REDACTED] goodnight [REDACTED] continued to kiss [REDACTED] rolled over on top of her and prepared to have sexual intercourse with [REDACTED] removing his believed there was nothing further she could say to dissuade [REDACTED] from having sexual intercourse with her [REDACTED] removed [REDACTED] panties and “tho yan penetrated her vagina with his penis Syphysically recoiled from this physical reaction [REDACTED] repeatedly penetrated [REDACTED] vagina with his penis .(H[REDACTED] ytold [REDACTED] that he was hurting her, and attempted to slow or stop his movements by pushing a hand against his hips. [REDACTED] not reply verbally and did not cease his actions. After approximately two (2) minutes of sexual intercourse [REDACTED] proceeded to remove his penis from [REDACTED] vagina and ejaculated on her stomach. On 19JUN19, NCIS interviewed [REDACTED] Provided he and[REDACTED]dated and regularly engaged in sexual intercourse beginning in JAN19. [REDACTED] provided that on 15MAR19 , (4[REDACTED] advised him they should limit their sexual contact during their trip to Pittsburgh, PA. After driving to Pittsburgh, PA beginning on 15MAR19 and arriving at their hotel at approximately 0300 hours on 16MARI19 [REDACTED] reported he engaged in sexual intercourse with [REDACTED] provided[REDACTED] ¢)£Linched, appeared to be in pain, and placed a hand against his chest pushing against him while he penetrated her vagina with his penis in the "missionary position [REDACTED] completed the sexual intercourse by removing his penis from [REDACTED] vagina and ejaculating on her and the (4) , (o informed him that he had made her bleed, and [REDACTED] drops of blood [REDACTED] observed[REDACTED] ¢)in visible discomfort throughout the day on 16MAR19. Interviews with family members and friends of[REDACTED] corroborate [REDACTED] account of the incident and the reported vaginal pain in subsequent days. (H[REDACTED]did not undergo a sexual assault forensic examination (SAFE), but did receive medical treatment for vaginal trauma reportedly sustained during the incident. ON 13OCT20, NCIS received the Sexual Assault Disposition Report (SADR) from [REDACTED] command. The Prosecutorial Merit Review Board recommended against preferring criminal charges .[REDACTED] declined to participate in the Administrative Separation board. NARRATIVE

1. This reactive investigation pertains to the suspected violation of Article 120 (Sexual Assault) of the Uniform Code of Military Justice (UCMJ). References (A) through document previous investigative activity.

2. On 13OCT20, NCIS received the Sexual Assault Disposition Report (SADR) from [REDACTED] command. The Prosecutorial Merit Review Board recommended against preferring criminal charges .[REDACTED] declined to participate in the Administrative Separation board. The board found no basis for misconduct [REDACTED] retained by the USN; Exhibit (19) pertains.

3. On 01DEC20, Special Victim Investigation and Prosecution (SVIP) notifications and notifications of the closure of this investigation were made to [REDACTED] (p\ Commanding Officer O), NMCP, and [REDACTED], Victim's Legal Counsel (VLC, [REDACTED], Regional Legal Services Office (RLSO) Mid Atlantic; and [REDACTED], Sexual Assault Response Coordinator (SARC). Previous notifications were provided on 11NOV19, 13OCT19, and 18NOV19.

4. On 04DEC20, Reporting Agent (RA) submitted the R-84 Disposition Report for [REDACTED] Investigator [REDACTED], CIV, to be entered into the National Crime Information Center (NCIC) reporti\[REDACTED] yerified the disposition for [REDACTED] entered correctly with no errors.

5. On 07DEC20, Reporting Agent (RA) conducted social media checks on[REDACTED] open source database inquiries. Nothing of evidentiary value was obtained during the open source database inquiries, Exhibit (20) pertains.
