A woman assigned to or connected with Naval Ocean Processing Facility reported unwanted sexual conduct from a man aboard USNS Effective after she injured her hip in the ship's fitness area and sought medical help.

NARRATIVE

1. This investigation was initiated pursuant to suspected violation of 18 U.S.C. § 2244 (Abusive Sexual Contact) and 18 U.S.C. § 3261-3267 (Military Extraterritorial Jurisdiction Act).

2. On 28MAY17, NCISRA Whidbey Island was notified by [REDACTED], Sexual Response Assault Coordinator for Naval Air Station Whidbey Island (NASWI), WA of an allegation by [REDACTED] Naval Ocean Processing Facility (NOPF), that she received unwanted sexual contact from [REDACTED] while deployed at sea aboard the USNS EFFFECTIVE (T-AGOS 21) (b)(), [REDACTED] stated the incident occurred on 23MAY17 and was originally reported as restricted but was recently made unrestricted[REDACTED] later informed NCISRA Whidbey Island that [REDACTED] being recalled to NASWI and would arrive on 01JUN17. On 07JUN17, [REDACTED] Principal Deputy Chief for the Department of Justice (DOJ) Human Rights and Special Prosecutions Section was contacted and briefed regarding the details of [REDACTED], allegations. Sexual Contact) had been not met because there was no unwanted sexual contact of the genitalia, anus, groin, breast, inner thigh, or buttocks [REDACTED] stated based on the allegation the only possible charge would be under 18 U.S.C. § 113 [5] (Simple Assault) which is a misdemeanor offense and does not fall under MEJA. \ ) [REDACTED] ycystated based on the allegation reported the DOJ would not prosecute or take any action against [REDACTED] provided Reporting Agent (RA) with DOJ's declination to prosecute [REDACTED] email. 5. Prior to NCIS assuming prior jurisdiction the USNS EFFFECTIVE started a command investigation into the alleged incident. Records related to the command investigation were later provided to NCISRA Whidbey Island. The relevant medical records. A copy of these documents shall be retained in the notes section of case file.

6. The following databases were queried for [REDACTED] Department of Defense (DoD) Person Search, National Crime Information Center (NCIC) Interstate Identification Index, NCIC and local wanted persons systems, National Law Enforcement Telecommunications System (NLETS), NCIS Case Information System IS) and K-NET, Defense Criminal Investigative Index II), Navy ( ), Joint Personnel Adjudication System (JPAS), and the Defense Law Enforcement Data Exchange (D-DEx). No derogatory information was found.

7. Investigator (INV) [REDACTED]conducted a review of [REDACTED] military service records. INV [REDACTED] (o\ did not find any information relevant to the captioned investigation. Refer to Exhibit (3) for additional details.

8. Since the inception of this investigation [REDACTED] Commanding Officer, NOPF; [REDACTED] Staff Judge Advocate, NASWI; and [REDACTED] SARC, have been apprised regarding the status of this investigation. Additionally, [REDACTED] of Crowley Government Services and [REDACTED] Master, USNS EFFFECTIVE were also briefed on the outcome of captioned investigation.

9. A copy of this report is being provided to [REDACTED] Crowley Government Services at 9487 Regency Sq. Blvd., Jacksonville, FL 32225 [REDACTED]informed NCISRA Whidbey Island he will be responsible for conducting a command investigation into the alleged incident after the investigation is closed by NCIS.

10. Due [REDACTED] allegations not meeting the criminal elements for a violation of the 18 U.S.C § 2244 (Abusive Sexual Contact) or any other felony level crime under MEJA and the declination to prosecute by the DOJ this investigation is hereby closed.
