EXECUTIVE SUMMARY

1. This investigation was initiated on 05Jul11 subsequent to the receipt of information froms)[REDACTED] Ehat she may have been sexually assaulted in her barracks room aboard NAVSTA Rota, Spain in the early morning hours of 04Jul11 following a command social function. [REDACTED] other command witnesses recalled her drinking multiple alcoholic beverages at two separate command functions. [REDACTED] reported that she was very intoxicated prior to leaving for her room. The alleged attackers were two unknown males whom followed her to her room on the second deck of Bldg 567, NAVSTA, Rota.

2. Multiple interviews of MSRON 2 personnel, hospital staff, base Lae . [J : personnel, civilian MSC sailors, and [REDACTED] have been conducted in an effort to identify a credible suspect without success. A cognitive interview of [REDACTED] been conducted and a composite sketch created. The sketch was shown to personnel at separate commands who were working aboard NAVSTA Rota during the time of the incident. None could recall a person bearing a similarity to the sketch. The clotheg [REDACTED] wearing at the time of the alleged incident were collected, logged into evidence and subsequently sent to the United States Army Criminal Investigation Laboratories (USACIL) for forensic analysis. The DNA analysis did not detect any semen or male DNA among the [REDACTED] clothin . No male DNA was found within the multiple samples taken Fromio\[REDACTED] part of the sexual assault kit. No credible suspects have been developed to date. A Sexual Assault Disposition Report (SADR) was completed by Judge Advocate General (JAG) representatives from the Regional Legal Services Office (RLSO) Rota, Spain and [REDACTED], Commodore, Task Force Six Eight TF 68). As detailed within the SADR, the Convening Authority A), CTF 68, did not proceed with a trial on alleged violations of UCMJ Article 120, Aggravated Sexual Assault as no credible suspect had been identified.

NARRATIVE

1. This reactive investigation was begun pursuant to possible violations of Article 120 - Rape, Sexual Assault and other Sexual Misconduct, of the Uniformed Code of Military Justice.

2. On 27Jani2, a copy of the Sexual Assault Disposition Report (SADR) related to the alleged assault of [REDACTED] received. The SADR was completed by Region Legal Service Office (RLSO) Europe Africa, Southwest Asia (EURAFSWA) and [REDACTED], Commodore Commander Task Force Six Eight TF 68). Disposition is recorded as offender unknown, as no credible suspect was identified, Exhibit (48) pertains.

3. On multiple occasions [REDACTED] EURAFSWA, Rota, Spain [REDACTED] Commanding Officer, MESRON 2, have been briefed on the status of this case.

4. On 30Jani12 [REDACTED] informed of the impending closure of this investigation. She did not relay any questions about the investigation nor voice any concern over its closure [REDACTED] Qwas provided contact information for SA [REDACTED] Gand confirmed her home address and contact information in Virginia. This case will be reopened following the identification of new information. This investigation is closed.
