EXECUTIVE SUMMARY

On 04Mar16, [REDACTED] ‘ Sexual Assault Response Coordinator (SARC) notified NCISRA Naples, Italy, that USS MOUNT WHITNEY (LCC-20) Command had informed him of a potential sexual assault involving two of the Military Sealift Command (MSC) civilians assigned to the LCC-20. The LCC-20 Command Duty Officer, [REDACTED], subsequently informed NCISRA Naples that, earlier on 04Mar16 [REDACTED] notified her MSC Supervisor, Chief Mate [REDACTED] Civilian, [REDACTED] grabbed her breast and bit her ear, on the night of 22Feb16 [REDACTED] reported that she informed a coworker of the assault and then she informed [REDACTED], a friend, who was also a Victim Advocate (VA) for the ship, a few days after the assault occurred. Record checks were conducted for both [REDACTED] reported that, on 22Feb16, at approximately 1800 hours [REDACTED] grabbed her from behind, wrapping his arms around her. [REDACTED] then allegedly squeezed [REDACTED] right breast and bit her left ear. When [REDACTED] moved his hands down [REDACTED] body, she freed herself of his grasp and walked away. Also on 06Mar16 [REDACTED] Supervisor, and [REDACTED] Civilian, were interviewed, and a crime scene examination was conducted. During a non-custodial interview, [REDACTED] denied the allegations and expressed his belief that [REDACTED] convinced [REDACTED] make "false allegations" against him, so that he would be removed from the ship. On 10Mar16 [REDACTED], U.S. Attorney, Department of Justice, declined prosecution of this case. NARRATIVE

1. This reactive investigation pertains to alleged violations of Title 18 U.S. Code 113 (Assaults within Maritime and Territorial Jurisdiction). Reference (A) details activity to date.

2. On 10Mar16é, this investigation was briefed to [REDACTED], U.S. Attorney, Department of Justice, who declined prosecution of this case. Subsequent to Reference (A), on 16Mar16 [REDACTED] Europe and Africa Counsel, notified NCIS of a potential second allegation of sexual assault by [REDACTED] background, [REDACTED], who is also a Victim Advocate, aboard USS MOUNT WHITNEY (LCC-20), indicated that, during a Facebook conversation, [REDACTED] disclosed that [REDACTED]nad "pressed against her and tried to kiss her while grabbing her wrist and pulling her towards him." However, On 25Mar16é, NCISRA Souda Bay personnel attempted to interviewo)[REDACTED] declined to participate in an investigationy)[REDACTED] advised [REDACTED] ‘tried to kiss her and she stopped him. She opined she was not a victim of a sexual assault, Reference (B) pertains.
