A service member connected to USS Boxer reported that a sexual encounter in a Naval Base San Diego barracks room became nonconsensual after she wanted to stop.

The reporting person told NCIS that the other person became angry, grabbed her, threw her onto a bed, and tried to force her legs open. She said she believed the subject was attempting to forcefully penetrate her.

The reporting person said she used her feet against the subject's chest, open-hand slapped the subject's outer thigh, and kicked the subject off before the subject got dressed and they argued. She reported no visible injuries and did not seek medical attention.

NCIS Major Crimes Response Team responded, took a statement, documented the barracks-room scene, reviewed text messages from around the night of the incident, interrogated the subject, collected fingerprints and DNA, tracked a Military Protective Order, and coordinated with command and legal offices.

1. This reactive investigation pertains to a suspected violation of Article 120 (Aggravated Sexual Contact) of the Uniform Code of Military Justice (UCMJ) .

3. On 16Jul118, Reporting Agent (RA) contacted [REDACTED] JAGC, Trial Counsel, Region Legal Southwest (RLSO), USN regarding the status of this investigation [REDACTED]relayed [REDACTED] been taken to Non-Judicial Punishment (NJP) and supplied RA with the Sexual Assault Disposition Report (SADR). Exhibit (13) pertains.

4. On 20Ju118, RA completed and emailed the Final Disposition Report (R-84) to the Federal Bureau of Investigation, CJIS Division, Clarksburg, WV to reflect the NJP disposition.
