EXECUTIVE SUMMARY

1. On 02Oct12, NCISRA Marianas was contacted by [REDACTED], Helicopter Sea Combat Squadron, Two-Five (HSC-25) regarding the report of a sexual assault that occurred circa June 2012 in Sasebo, Japan betweem [REDACTED] USN, HSC-25, and [REDACTED] a USN, HSC-25 Detachment, USNS Amelia Earhart. On 03Oct12 [REDACTED] interviewed by NCISRA Marianas and provided a sworn statement indicating that on approximately 15Jun12 [REDACTED] grabbed [REDACTED] the back of the head and kissed [REDACTED] while placing her tongue in [REDACTED] mouth without his consent [REDACTED] provided a DD Form 2701, Victim/Witness Pamphlet. Inquiries with the National Crime Information Center (NCIC) database for [REDACTED] were met with negative results. Inquiries with the Defense Central and Investigations Index II) revealed one dossier file concerning [REDACTED] record was found concerning [REDACTED] Joint Personnel Adjudication System (JPAS) inquiries indicated that [REDACTED] possesses SECRET clearances. Inquiries with the Hawaii Law Enforcement Information Exchange (LINX) database revealed criminal history for [REDACTED] review of [REDACTED] Service record book (SRB) did not reveal any derogatory information. A review of [REDACTED] revealed prior Non-Judicial Punishment for violations of the UCMJ. Relevant witness interview were conducted and met with negative results as no one witnessed the aforementioned incident. Attempts to interview [REDACTED] were met with negative results as [REDACTED] declined to be interviewed. Command and RLSO Japan was briefed on the status of this investigation and the determination was made not to pursue charges against [REDACTED] to a lack of evidence and conflicting statements of [REDACTED] This investigation is closed.

NARRATIVE

1. This reactive criminal investigation was initiated regarding suspected violations of Uniformed Code of Military Justice (UCMJ) Article 120 (Sexual Assault).

2. Subsequent to the submission of reference (D), on 21May13, [REDACTED]USN, CO HSC-25, advised that the investigative case file concerning (b (Q)was reviewed and no judicial or administrative action would be taken concerning [REDACTED] Exhibit (14) pertains.
