1. Investigation was initiated on 01Dec07 following the report that [REDACTED] sexually assaulted by [REDACTED] alleged incident occurred on 25Nov07 aboard the USNS GUADALUPE (T-AO 20 while the ship was in port at Naval Station Pearl Harbor, HI [REDACTED] was interviewed and provided details of how she first met [REDACTED] advances he made towards her that first evening and the alleged sexual assault the following day. 1. This investigation is being conducted under the suspected violation of 18 United States Code Section 2241, Aggravated Sexual Abuse.

2. Subsequent to the submission of Reference (A [REDACTED] refused to cooperate in further investigative efforts or any prosecution of [REDACTED] such [REDACTED] JAGC USN, Special Assistant United States Attorney (SAUSA), Honolulu, HI has declined prosecution in captioned investigation citing lack of evidence to proceed.
